Subject: 9464/1990-135/wakefield Date: Mon, 27 Feb 1989 12:20:00 -0500 1990-135 Paul Wakefield ORDINANCE NO. 9464 AN ORDINANCE CLOSING AND ABANDONING A PORTION OF CORNELIA ALLEY LOCATED NORTHEAST FROM WEST 19TH STREET, BETWEEN MARKET STREET AND LONG STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned a portion of Cornelia Alley located northeast from West 19th Street, between Market Street and Long Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Cornelia Alley, beginning on the northeast line of West 19th Street some 193 feet northwest of the intersection of the northeast line of West 19th Street with the northwest line of Market Street, thence northwest 16 feet with West 19th Street, thence northeast some 19 feet, thence northeast some 169.25 feet to a point 22 feet southwest of the northeast corner of lot 4, Cummings Estate Subdivision, as shown by plat of record in deed book V, volume 9, page 572, R.O.H.C., thence southeast 12 feet to the northwest corner of lot 15, said Cummings Estate Subdivision, thence southwest 188 feet to the northeast line of West 19th Street, the point of beginning. Said alley separates lot 1-3 and part of lot 4, from lots 15-18, said Cummings Estate Subdivision. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 2. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 3. The areas reserved for the above easements shall be kept free and clear of all structures. 4. Resubdivision of the adjacent property to prevent any land-locked parcels. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law, provided, however that this Ordinance shall not be operative until the completion of condition no. 4 in Section 2 above.
